Mediation

As a mediator, Robert Boliek is committed to facilitating communication between parties in the hope of achieving voluntary settlement based not only on the parties' mutual interests but also on each party's enlightened self-interest.

The key word here is "enlightened." Although he is a facilitative rather than an evaluative mediator, Robert Boliek will confidentially test the parties' expectations where it is fair and appropriate to do so. As an example, he might employ such techniques as a decision-tree analysis to help clarify the consequences of a party's own evaluation.

The goal, as always, is that the parties leave the mediation--if not with the settlement of the dispute--then at least with a clearer sense of exactly why not settling is a better alternative than settling. This can only happen after a full, frank, and fair consideration of the viable alternatives in a neutral environment that encourages dialogue, promotes respect for each party's interests, and fosters mutual understanding.

Robert Boliek is registered on the Alabama State Court Mediator Roster and the Appellate Mediator Roster, serves on the A.D.R. Committee of the Birmingham Bar Association, is a pro bono mediator for the Jefferson County Court Mediation Project, and has taught dispute resolution at the law school level. He has mediated disputes involving personal injuries, construction contracts, product warranties, landlord-tenant issues, and property taxes.
